Well now... Here's a surprise!  We all knew this court date was coming... but who knew the court would rule in Maria Vladimirovna's favour? :-)

Tsar murder case dropped illegally – ruling

Moscow, May 12, Interfax - Moscow City Court has ruled that the criminal case over the murder of the last Russian Emperor Nicholas II and his family was closed illegally.

The court thus granted an appeal from lawyer German Lukyanov, who represents the interests of Grand Duchess Maria Vladimirovna, the disputed head of the Romanov Dynasty, an Interfax correspondent reported.

The court ruled that the case files be sent back to the lower court and ordered a second hearing by a different panel of judges.

On March 19, Moscow's Basmanny Court rejected Lukyanov's complaint by upholding the decision to terminate the criminal case over the killing of Tsar Nicholas, his wife Empress Alexandra, and their five children, in July 1918.

On October 1, 2008, the Russian Supreme Court ruled on the rehabilitation of Nicholas II and his family, however, on January 15, 2009, a court ruling terminated the case over the execution of the royal family.

The House of Romanovs disagreed with the Investigative Committee's claims that the royal family were victims of ordinary criminals and
insisted that they were killed by the Soviet Communist regime of that time.

   Does this mean we will finally have an inquest & aquire those death certificates, and will the court ruling apply to the 2007 remains as well. I can't help but feel this is long overdue, it is a process which should have started in 1991 and again in 2007. A favourable outcome may change the ROC view on matters too.

Russian Church urges not to hurry confirming identification of Crown
Prince Alexey and Grand Princess Mary's probable remnants

Moscow, June 16, Interfax - The Russian Orthodox Church urges not to
hurry to officially confirm identification of remnants found in 2007
not far from Yekaterinburg, which, according to investigators, belong
to Nicholas II's children.

"I believe that nothing makes us hurry today. Funerals will tempt us
to think that we can draw a line under the affair. However, it's not
true," head of the Synodal Department for Church and Society Relations
Archpriest Vsevolod Chaplin told Interfax-Religion on Wednesday.

Commenting on the recent statement made by the Senior Criminalist of
the Forensic Science Office at the Russian Prosecutor's Investigative
Committee Vladimir Solovyov that the remains found in 2007 indeed
belonged to Crown Prince Alexey and Grand Princess Mary, Fr. Vsevolod
urged "to seriously compare all scientists' divergent positions" on
the question.

Besides, the Moscow Patriarchate official believes it necessary to
compare "results of the investigation held under Kolchak to the
current investigation and still the most important is to name those
who are guilty."

Investigative Committee: Nicholas II executed without Lenin's order:
Moscow, June 15 (Interfax) - The last Russian Emperor Nicholas II and
his family were executed by order of the Urals Council without the
consent of Vladimir Lenin and Yakov Sverdlov, the two most senior
Communist leaders at the time, the Investigative Committee under the
Prosecutor General's Office said.

"This is totally correct. Without their knowledge. We have not a
single document that would show that there was an official decision to
execute the Tsar's family," Vladimir Solovyov, a senior criminologist
with the Investigative Committee, said on Ekho Moskvy radio on
Tuesday.

On January 15, 2009, Solovyov, who was a serious crime investigator at
the time, issued a resolution terminating a criminal inquiry into the
killing of Nicholas II and his family.

The head of the House of Romanov, Grand Duchess Maria Vladimirovna,
has appealed against the resolution.

Two full years after the identification tests.... It is the Orthodox Church that now "urges not to hurry official confirmation" of the identification of "probable remnants" found in 2007.

It is the leaders of the Orthodox Church you should now be asking that question.

Lisa, I understand where euphoria could over power reasonable thinking, especially when it comes to Anna A etc,. What, though, is the thinking of the Church? Church authorities are pretty adamant that a scar has to be there - to the point that they are making its resolve a condition for them to finally accept the buried bodies, at the Peter and Paul Cathedral, to be the Royal Family's. How can they be made to accept that, as you say, a scar doesn't necessarily need to be there?
And, if all the DNA facts are there, why are they continuing to refuse to accept the findings if this scar thing can't be proved? JonC.

Whose euphoria would that be, JonC? If you're referring to me - I have been kept informed about tests on the Ekaterinburg remains for many years. I have yet to get euphoric! For your information, I am one of several historians who have seriously studied the AA case as well as the stories of perhaps a dozen claimants with an open mind and very reasonable thinking. After years of study, I am of the opinion that the IF died together that night. I have no agenda to prove, no tickets to sell, and if someone can come up with a plausible survivor story that includes the DNA tests already done, I am one of few people who would listen.

As I am not Orthodox nor Russian, I have no insights into the thinking of the Church. But, I am disturbed that they are trying to wantonly destroy the Pig's Meadow burial site because they think the family was permantently buried at the 4 Brothers. I would never advocate destroying either site. I wonder, what are they afriad of? And why do they irrationally insist on asking for proof that it has been medically established could not exist? It's as though they're withholding approval until I can prove I have a Y chromosone? I have been assured by all the teams of scientists that the DNA tests for all the victims is there.

The only way I know todeal with irrationaity is with rationality. Now, what is your agenda here, Jon C?



I'm sorry, Lisa, I missed your reply. I've always noted your opinions as very straight forward and scholarly honest. I don't for a second think otherwise. I was referring to those who aren't as astute and simply follow on with ridiculous assumptions. No-one in particular, of course. As to my agenda, here on this site, is nothing at all but a sharing of information. Overall, to finally prove that Mr. LoPresti's claim is true BUT, rest assured, I respect the position of this website not to discuss his claims. I believe I have done that. Your ' Y Chromosome ' remark is a jab at me, obviously, but you needn't be angry since your position is assured by your ' teams of scientists ' as you say. Nevertheless I will continue with the new discovery. Peace, and good will to you, fair Lisa. JonC.

Hi JonC - the Y chromosome remark was in no way personally directed towards you or any other male, for that matter. It was no jab, and if it came across that way, I do apologize. I'm not so much angry about the continued disbelief in the identification of the Ekaterinburg remains as incredulous - especially at the Church. But, as I said, I can only continue to be rational about his in the face of irrationality from the ROC.
